Web 3.0: Online Privacy Law, Politics and Business Issues of the New Decade


The Fall 2010 Hastings Communication and Entertainment Law Journal (Comm/Ent) Symposium will take place from 9:30 am to 5:30 pm on Thursday, September 23, 2010. The symposium will be located in the Alumni Reception Room (ARC) on the second Floor of the UC Hastings, 200 McAllister building in San Francisco.

9:30 AM - 9:50 AM: REGISTRATION & CONTINENTAL BREAKFAST

A registration table will be set up in front of the ARC. The event is free and you may come and go to any presentations you like. Attorneys must sign in and out of the symposium upon each arrival and departure to receive MCLE credit.

9:50 AM - 10:00 AM: OPENING REMARKS

The symposium moderator, Nicholas Allard, Partner at Patton & Boggs, will present the opening remarks.

10:00 AM - 11:00 AM: CAN INTERNET ADVERTISING BE REGULATED?

Internet advertising has exploded over the last fifteen years. Every marketer now has the capacity to reach an international audience. The challenges of regulating advertising in this environment are immense. Marketers can operate from anywhere and hide their true identity. They can try to insulate themselves from responsibility through affiliate marketing networks. They can serve up ads a consumer “wants to see” even before the consumer knows he or she wants to see them. This session will address how the FTC is handling these challenges. It will also address key regulatory issues related to social media marketing, behavioral advertising, effective online disclosures, and affiliate marketing. Speaker: Richard Cleland, Assistant Director of the Division of Advertising Practices at the Federal Trade Commission. (1 MCLE credit)

11:00 AM - 12:15 PM: PANEL 1--WHAT'S NEXT FOR INTERMEDIARY LIABILITY IN COPYRIGHT LAW?

After discussing the background of secondary copyright infringement liability for Internet-related service providers and available defenses under the DMCA, Panel 1 will analyze several recent cases, and make projections about the direction of litigation and non-litigation trends in this important field. Topics will include the latest developments in copyright liability for file sharing, making clips from your favorite TV shows available on YouTube, and more. Panelists include: Andrew Bridges, Partner at Winston Strawn; Lila Bailey, Creative Commons; Kelly Klaus, Partner at Munger, Tolles and Olson; and Christian Mammen, UC Hastings Professor. (1.25 MCLE credits)

12:15 PM - 2:00 PM: LUNCH & KEYNOTE ADDRESS ON DATA PRIVACY LAW

During lunch, Lothar Determann, Partner at Baker and McKenzie, will give the keynote presentation. The keynote will ask the question: Where is the Free Communications Officer that protects social networking from the Privacy Officers? Users of social networking sites and the Internet more generally want to freely share and obtain information, ideally free of charge and restrictions. Data privacy laws, authorities, officers, advocates and plaintiffs are demanding restrictions on data availability and use. In the current hysteria, government representatives in Europe are vocal about canceling their social media accounts, taking actions against providers, demanding that photos of government buildings are removed from the geographic mapping and information sites and the horrendous threats to humankind coming from social media. Who is standing up for free information, communications and speech on data privacy laws including their sources, both domestic and international, and emerging regulations? (1.5 MCLE credits)

2:00 PM - 3:15 PM: PANEL 2--SOCIAL MEDIA PRIVACY

Panel 2 will explore recent controversies surrounding internet privacy, emphasizing privacy in social media. The panel will consider topics including the line between personal responsibility and corporate liability; and regulations surrounding data portability and the ability to delete information on social media sites. Panelists include: Nicholas Allard, Partner at Patton & Boggs; Laura Berger, Federal Trade Commission: Division of Privacy and Information Protection; Nick Conley, American Civil Liberties Union of Northern California; Lauren Gelman, Stanford Law Professor; and Lothar Determann, Partner at Baker & McKenzie. This panel will be moderated by Professor Chris Hoofnagle, Berkeley Center for Law and Technology. (1.25 MCLE credits)

3:15 PM - 4:15 PM: INTERNATIONAL REGULATORY ENVIRONMENT

Kevin Martin, Partner at Patton & Boggs and former Federal Communications Commission Chairman, will present on the increased role of government regulations both domestically and abroad. From net neutrality to privacy, government oversight creates both challenges and potential opportunities. This session will provide an overview of the global regulatory environment and its impact on innovation. (1 MCLE credit)

4:15 PM - 4:30 PM: CLOSING REMARKS

The symposium moderator, Nicholas Allard, partner at Patton & Boggs, will present the closing remarks.

We are located next to the Civic Center/UN Plaza station.

From the East Bay
By car: from the Bay Bridge, exit right at Civic Center (after you pass the 5th Street exit). Stay in one of the two right lanes. Merge onto Harrison and make a right turn onto 9th Street. Cross Market on 9th Street in one of the right hand lanes, marked "Larkin Street," which will intersect both McAllister Street and Golden Gate Avenue.  There is parking in the Hastings Garage on the corner of Larkin and Golden Gate at 376 Larkin.

From the North Bay
By car: from the Golden Gate Bridge take Lombard Street to Van Ness Avenue. Turn right onto Van Ness and continue to McAllister Street. Turn left onto McAllister, go two blocks, turn left onto Larkin to access the Hastings Parking Garage at the corner of Larkin and Golden Gate at 376 Larkin.

Parking:

The Hastings Parking garage has been kind enough to offer all day parking for $10 for guests attending the symposium.  Simply pay at the cashier’s station and mention the Comm/Ent symposium.  Parking does fill up quickly, usually by 10:30am on a Thursday, so be sure to arrive early.
