Kevin M. McCarthy


Kevin M. McCarthy is a Judge of the San Francisco Superior Court. He worked as an assistant public defender in Alameda County for eleven years before his election to the bench in 1996. Judge McCarthy is a 1980 graduate of the University of California at Santa Barbara and a 1985 graduate of the University of California, Hastings College of the Law.

He has served as an assistant adjunct professor at both Hastings College of the Law and Boalt Hall School of Law at UC Berkeley. He has taught first year criminal law, trial advocacy and a seminar on jury selection.

As a judge he has been assigned to a general civil trial calendar, felony jury trials and juvenile delinquency cases.  He currently presides over a felony trial department.

He is a former member of the Board of Directors of the Bay Area Lawyers for Individual Freedom (BALIF) where he served as chair of the Judiciary Committee. He is also a former member of the Board of Directors of the International Association of Lesbian and Gay Judges.

He is currently a member of the Criminal Law Advisory Committee to the California Judicial Council and a former member of the Judicial Council Probation Services Task Force. He has served in the past as a member of the Ethics Education Advisory Committee to the Judicial Council, the Judicial Council Task Force on Judicial Ethics and the California Judges Association Ethics Committee.

In addition, Judge McCarthy has taken an active role in providing continuing education to judges through his work at the California Center for Judicial Education and Research. He has served on the organizing committees for several institutes and he has taught courses on search and seizure, criminal jury instructions, new judge orientation and ethics.

Judge McCarthy and his husband Dr. David Bui have a five-year old son, Gavin.
