A California native, Professor Cunningham has been on the Hastings faculty since 1973. He received a B.S. degree from UC Berkeley, and was in the first class of graduates from the "new" law school at UC Davis in 1969. Traveling to Washington, D.C. on a fellowship, he earned an LL.M. in natural resources law (with highest honors) from George Washington University, served on the George Washington adjunct faculty, and practiced with the general counsel of the U.S. Army Corps of Engineers. His responsibilities with the Corps included the design and drafting of major water pollution and wetlands control regulations and programs. His teaching has encompassed the area of land and the environment, including land use regulation, property, state and local government, environmental quality law, water resources, and archeology. He is a co-author (with Grodin and Massey) of The California Constitution: A Reference Guide; a contributing author to Thompson on Real Property; and the author of Archeology, Relics and the Law (1999, 2004). He served as Associate Academic Dean of Hastings from 1981 to 1985.

His non-academic activities focus on conservation and government issues, including positions as a museum officer, city planning commissioner, city council member, regional urban policy board member, and scout leader. In real life, he and his wife Sue (a former elementary school teacher) raised two sons, Matthew and Nathan, and devote themselves to old house conservation, hiking, cross-country skiing, canoeing, and the continuously unfolding mysteries of life.
