Join us for an intriguing discussion with Professor Margreth Barrett. Courts have expressed a wide range of views about the ways an infringement defendant must “use” a trademark online in order to be liable. In just the past few years the Court of Appeals for the Second Circuit has essentially reversed its position on this issue, and the Ninth Circuit’s views have migrated significantly, as other circuits have lined themselves up at diverse points along the continuum of “use” possibilities.
How can lawyers navigate these turbulent waters, and what should be the points of reference? Professor Barrett will provide some ideas and suggestions.
