A Great Debate: The Right to Cite Unpublished Decisions

Three years ago, the Federal Rules of Appellate Procedure added Rule 32.1, which prohibits federal courts from banning the citation of unpublished federal judicial opinions or other written dispositions of cases. The California state courts have not adopted this rule change, and continue to ban the citation of unpublished state court opinions.
Chief Judge Alex Kozinski of the Ninth Circuit, who was a leading opponent of the federal rule change, will debate Associate Justice Mark Simons of the California Court of Appeal on the wisdom of the federal and state practices. Professor Joseph Grodin will moderate and will also provide his views on California's depublication practice.
