Supreme Court Affirms Samantar v. Yousuf
In a decision released this morning in Samantar v. Yousuf, the U.S. Supreme Court unanimously adopted the position advocated by Professors Bill Dodge and Chimène Keitner in separate amicus briefs. Both argued that the Foreign Sovereign Immunities Act does not apply to individual officials.
Professor Keitner continues to do research on the next question, which is whether officials nonetheless retain some type of common law immunity.
