Congress’s Power of the Purse in a Polarizing Era

Congress’s appropriations authority has emerged as one of the most important constraints on U.S. Presidents. For that reason, it has also become a locus of increasingly intense political conflict, as evidenced by repeated appropriations lapses (colloquially known as “shutdowns”) in recent years. Despite the appropriations power’s increasing political salience and structural importance, however, major unresolved questions surround this congressional authority. Participants in this conference will address constitutional separation-of-powers questions, offer historical perspective on current conflicts, and address emerging administrative law issues.
